Terms of Use

These terms are an agreement between you and the operator of Closest Call ("Closest Call", "we", "us"). They cover the game at playclosestcall.com and everything connected to it (the "game"). By claiming a handle or playing, you agree to these terms, the Acceptable Use Policy and the Privacy Policy. If you do not agree, do not play.

The main points
  • You must be 18 or older to play.
  • Closest Call is a free game for entertainment only. It is not gambling.
  • Chips are play chips. They have no cash value and can never be bought, sold or cashed out.
  • There is no password reset. If you forget your password, we cannot recover your handle for you.

1. Who can play

You must be at least 18 years old, and you must be allowed to play under the laws that apply where you live. By playing, you confirm both.

2. A free game with play chips

  • The game is free. There is nothing to buy and no way to pay.
  • Chips, bank balances, tournament prizes, leaderboard positions and stats exist only inside the game. They have no monetary value and are not your property.
  • Chips cannot be bought, sold, traded, transferred, gifted outside normal play, or exchanged for money, goods or anything of real-world value. Any attempt to do so breaks these terms.
  • No real money or prizes of real-world value can be won.
  • Closest Call is a game of simulated betting for adults. Doing well here does not mean you would do well at real-money gambling.

3. Your handle and password

  • Your handle is your account. You sign in with your handle and the password you chose. Handles claimed before passwords were added also have a 12-word recovery code.
  • Keep your password and any recovery code private. Anyone who has them can take over your handle. We do not collect an email address, so there is no password reset: if you forget your password and are not signed in on any device, we cannot restore your handle, chips or stats.
  • After several wrong password tries, sign-in for that handle is paused for a short time.
  • You are responsible for everything done with your handle.
  • One person may not use more than one handle to gain an advantage. See the Acceptable Use Policy.
  • Handles are public. Do not use your real name or other personal information as a handle unless you are comfortable with everyone seeing it.
  • We may refuse, change or remove any handle, including handles that are offensive, misleading or that imitate someone else.

4. How the game is run

  • The rules of the game are part of these terms. We may change the rules, schedule, chip amounts, free chips, buy-ins and prizes at any time.
  • Banks reset at the start of each season.
  • Some seats are filled by house bots, which are computer players.
  • We may correct, adjust, reset or remove chips, results and stats at any time, for example to fix a mistake or bug, or to undo unfair play.
  • If something goes wrong, such as a bug, a lost connection or an outage, chips and results may be lost. We are not obliged to restore them.

5. Acceptable use

You must follow the Acceptable Use Policy. It covers cheating, automation, abuse of the service and handle rules.

6. Suspension and ending access

We may suspend or remove your handle, reset your chips and stats, or block your access at any time, with or without notice, if we believe you have broken these terms or for any other reason. You may stop playing at any time. To ask for your handle and data to be deleted, see the Privacy Policy.

7. Our content

The game, including its name, design, text, graphics and software, belongs to us or our licensors. We give you a personal, non-transferable permission to play it for your own enjoyment. You may share your hand results and invite links. You may not copy, resell, or build a competing service from the game.

8. Availability and changes

We may change, pause or shut down the game, or any part of it, at any time and without notice. We do not promise that the game will be available, uninterrupted, secure or free of errors.

9. No warranties

The game is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

10. Limit of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, chips, stats or goodwill, arising from or related to the game or these terms. Because the game is free, our total liability to you for all claims is limited to 50 US dollars. Some places do not allow some of these limits, so parts of this section may not apply to you.

11. Your responsibility to us

If your breach of these terms or your misuse of the game causes a claim against us, you agree to cover the losses and reasonable costs that result, to the extent the law allows.

12. Governing law

These terms are governed by the laws of the State of Florida, USA, without regard to its conflict of law rules. Any dispute must be brought in the state or federal courts located in Florida, unless the law where you live gives you the right to bring it elsewhere.

13. Changes to these terms

We may update these terms. When we do, we will post the new version here and change the effective date. If you keep playing after an update, you accept the updated terms.

14. General

If any part of these terms is found to be unenforceable, the rest still applies. If we do not enforce a term, that is not a waiver of it. You may not transfer your rights under these terms to anyone else.
